ENTRY INTO THE COMPETITION

1. Entry into The LifeStyle Channel “Come Dine With Me Party” competition (the “Competition”) is open to all residents of Australia who are over the age of 18 years. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions.
2. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter.
3. The Competition begins at 12:01am (AEDT) on Monday 18th January 2010 and closes at 11:59pm (AEST) on Monday 31st May 2010 (the “Competition Period”)
4. To enter the Competition and be eligible to win, entrants must:
   1. Be citizens or permanent residents of Australia;
   2. Be over the age of 18 years;
   3. Sign up to be part of a Come Dine With Me Party Series. A Come Dine With Me Party Series involves an initial registrant inviting other participants (a minimum two (2) and maximum of four (4)) to join their group whereby each participant takes a turn to host a meal and attend the meals cooked by the other participants (“CDWM Party Series”). Each meal hosted by an individual within a CDWM Party Series is referred to as a “CDWM Party”. Each member of a CDWM Party Series is referred to as a “Participants”;
   4. Complete the online registration form;
   5. Following completion of a CDWM Party, each Participant must score their host’s CDWM Party and then the host must upload photographs, videos or images of the CDWM Party to www.comedinewithme.com.au/party (“Entry”).
5. Each registration form must include the Participant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth to be eligible for entry. Incomplete entries or those with defamatory or offensive content will be ineligible. It is the Participants’ responsibility to inform the Promoter if their residential address, email address or phone number changes during the Competition Period.
6. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited. At the sole discretion of the Promoter, if the Promoter reasonably believes that a Participant is using any form of automated software, the Promoter may disqualify that Participant without notice.

   Prize

7. There are 25 prizes in total. Each month throughout the Competition Period, the Promoter will judge which CDWM Party is the most original and creative and will award that person, together with each Participant in that person’s CDWM Party Series one of the monthly prizes outlined in Table A below. Participants’ scores given as part of a CDWM Party Series will not be used to determine the winner – the decision will be made by the Promoter, in its sole discretion.

   (the “Prizes”).
8. The total maximum Prize pool value is $11,380 (x5 KitchenAid blenders valued at $299 each, x5 KitchenAid stand mixers valued at $729 each, x10 KitchenAid chef’s basic food processors valued at $399 each, x5 KitchenAid toasters valued $450 each,). The Prize values are the recommended retail values as provided by the suppliers and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value of the Prizes occurring between publishing date and date the Prizes are claimed. All Prize values are in Australian dollars.
9. The Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other prizes. The contents of the Prizes will be at the Promoter’s sole discretion. The Prizes are subject to availability and the terms and conditions of the entities supplying the Prizes.
10. Only one Prize per person will be awarded during the Competition Period. A Prize will be awarded to an individual who has completed a CDWM Party that is judged by the Promoter to be the most creative and original for that month, and then each Participant in that individual’s CDWM Party Series will then also receive a Prize. Entries carry over each month during the Competition Period – eg. if you complete your CDWM Partyr in January and do not win, your CDWM Party is still eligible to win a Prize in subsequent months.

    JUDGING AND AWARD OF PRIZE

11. The Competition will be judged on the basis of creativity at the LifeStyle Channel, Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 in accordance with the dates outlined in Table A in clause 7. Chance plays no part in the selection of the Prize winners. The Prize winners will be notified via phone or email and their names published on the LifeStyle Channel website in accordance with the dates outlined in Table A in clause 7 above. Each Prize winner must claim their Prize within 7 days of the publication of the Prize winner’s name.
12. If a Prize winner cannot be contacted or does not claim the Prize by the stipulated date, then the Prize will be forfeited and a substitute prize will not be offered in lieu of the Prize.

    AGE

13. You must be over 18 years old to enter the Competition. Any registration from persons who do not meet this age criteria will be ineligible to participate in a CDWM Party Series.

    General

14. All Participants agree to provide the Promoter or the Promoter’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a Prize winner or if reasonably requested by the Promoter or the Promoter’s authorised agent. Proof of age, identification, residency and entry considered suitable for verification is at the sole discretion of the Promoter. In the event that the Prize winner cannot provide suitable proof, the Prize winner will forfeit the Prize in whole and no substitute will be offered.
15. No responsibility will be taken by the Promoter, The LifeStyle Channel, FOXTEL, AUSTAR or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winner from winning the Prize.
16. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
    1. a Participant does not satisfy the Competition entry requirements; or
    2. the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control.
17. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
    1. (a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
    2. (b) be required to conduct the Competition at any other time.
18. Participants agree that by entering the Competition, their details (including but not limited to their name and/or log in name and profile picture) together with any or all images uploaded as part of the Competition may be used by the Promoter (and the Promoter’s agent as required) in all media worldwide and without notice and without any fee being paid unless otherwise advised by the Participant. Participants are also advised that by completing the entry requirements for this Competition, their information will be entered into a database which the Promoter may use for future promotional, marketing or publicity purposes in all media in perpetuity.
19. By uploading photographs, images or videos (“Content”) onto the website outlined in clause 4(f),as part of this Competition, Participants warrant that they are the copyright owners of the Content and that the Promoter’s use of the Content will not breach the rights (including copyright) of any third party. Participants who upload Content agree to indemnify the Promoter in the event that the above warranty is false.
20. The Promoter, in its sole discretion, may publish and/or edit Content for publication on its websites or in any other media.
21. No responsibility will be accepted by the Promoter for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promoter’s database and NOT time of transmission by the Participant. The Promoter will accept no responsibility for any delays to entry caused by technical disruptions or malfunctions. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the Participant cannot be contacted during business hours on the relevant dates.
22. The Promoter accepts no responsibility for any Prizes that are damaged, delayed or lost in transit.
23. The Promoter reserves the right to disqualify any individual who, as determined in the sole discretion of the Promoter, has engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition. The Promoter reserves the right to cancel the award of Prize/s where it has determined that the individual has engaged in unlawful or improper conduct or where he/she has otherwise breached these terms and conditions.
24. Participants are advised that their personal information may be disclosed to State and Territory lottery departments and their names as the winner may be published as required under the relevant lottery legislation.
25. A decision of the Promoter in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
26. Participants enter the Competition and participate in CDWM Parties at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prize or entering the Competition.
27. All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.lifestylechannel.com.au. By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.
